Renting out in Haryana: the rules

  • A lease for more than a year must be registered, and in a municipal area it needs a municipal No Dues Certificate, as a sale does.
  • The tenant pays the stamp duty. A lease of under a year pays the bond duty on the whole amount payable; one to five years, the bond duty on the average yearly rent.
  • Where the Haryana Urban (Control of Rent and Eviction) Act, 1973 applies, a tenant can be evicted only for the reasons in its section 13, through the Rent Controller.
  • Put the rent, the deposit, the notice period and who pays for repairs in a written agreement.

From section 17 of the Registration Act, 1908, Haryana's stamp duty schedule (item 35), the revenue FAQ on jamabandi.nic.in, and the Supreme Court on the 1973 Act (2022).
