Short answer: before you can sell inherited land in Tamil Nadu, the land has to be in the heirs' names. Get the death certificate and a legal heir certificate (varisu certificate) from the Tahsildar, transfer the patta to the heirs, and agree how to sell: either every legal heir signs the sale deed, or the others release their share to you first by a registered deed. Daughters have the same share as sons. If there is a will, the person it names sells, and buyers may ask for probate.

This guide takes you through each step, the problems that hold inherited land sales up, and the tax you may owe.

Step by step

  1. Get the death certificate from the corporation, municipality or panchayat where the death was registered.
  2. Get the legal heir certificate. Apply through an e-Sevai centre or the TN e-Sevai portal with the death certificate, your ID, the family card and address proof. The village officer and revenue inspector check the details, and the Tahsildar issues the certificate listing every legal heir.
  3. Collect the land documents: the deeds that show how the land came to the person who died, the current patta, chitta and FMB sketch from eservices.tn.gov.in, and a 30-year encumbrance certificate (EC) from tnreginet.gov.in.
  4. Transfer the patta to the heirs. Apply online with the death certificate and the legal heir certificate. Buyers expect the patta to show the sellers. Our guide to patta transfer in Tamil Nadu explains how.
  5. Agree how the family will sell. See the three ways below.
  6. Price the land, find a buyer and register the sale. The steps are the same as any land sale. See how to sell agricultural land in Tamil Nadu.

Three ways for a family to sell

WayHow it worksWhen it suits
All heirs sell togetherEvery legal heir signs the sale deed, and the money is shared as they agreeThe family agrees to sell the whole land now
Release deedThe other heirs release their share to one heir by a registered release deed, and that heir sellsOne person will handle the sale, or the others are settled in another way
Partition deedA registered partition divides the land, and each heir sells their own part. The survey number may need a subdivisionHeirs want to keep or sell their parts separately

Problems that hold inherited land sales up

  • A missing signature. Every heir on the legal heir certificate must sign or release their share. A sale without one of them can be challenged later, so serious buyers will not go ahead.
  • Daughters left out. Since 2005, daughters have the same rights as sons in family property. Their signatures are needed too, including married daughters.
  • An heir abroad. They can sign a power of attorney for someone in India. See selling property in India from abroad.
  • A minor heir. A child's share usually cannot be sold without the court's permission. Ask a lawyer before you agree anything with a buyer.
  • Old records. The patta may still be in a grandparent's name, or names and areas may differ between the deed, the patta and the FMB sketch. Fix these at the taluk office first.
  • A will. If the land passes by a will, buyers may ask for probate. Probate is no longer compulsory, even for property in Chennai: Parliament omitted section 213 of the Indian Succession Act, 1925 in December 2025.

Tax on selling inherited land

There is no tax when you inherit land. When you sell, any capital gain is worked out from the original owner's cost, and the time they held the land counts towards yours, so most inherited land is a long-term capital gain. Rural agricultural land is not a capital asset, so selling it carries no capital gains tax. Ask a chartered accountant about your own sale, especially if several heirs share the money.

This guide is general information, not legal or tax advice. Inheritance depends on the family's religion, any will and the facts of each case, so confirm with a lawyer in Tamil Nadu before you sign. Last updated October 2026.
