Sell from the app with the same account and the same fee, and see every enquiry on your phone.
Gmore helps NRI and OCI owners in the USA sell a house, a plot or land in India without flying back. You fill a 3 minute form and see your fee before you pay. Someone you trust lets our videographer in, and buyers contact you on WhatsApp, or Gmore takes every enquiry for you. To sign from the USA, give a power of attorney: sign the power of attorney before a notary in your state, then have it apostilled by the state's competent authority, usually the Secretary of State. The US and India are both parties to the Hague Apostille Convention, so a US apostille is valid in India. There is no commission: the fee to start is from ₹8,999 including GST, set for your property and shown before you pay, then ₹999 a month after the first month while it stays listed. If it is not sold in 18 months, you get a full fee refund, minus GST.

Signing a power of attorney in the USA
- Sign the power of attorney before a notary in your state, then have it apostilled by the state's competent authority, usually the Secretary of State. The US and India are both parties to the Hague Apostille Convention, so a US apostille is valid in India.
- If you prefer the Indian mission, the Embassy in Washington and the consulates take attestation applications through VFS Global since 1 August 2025, by post or in person.
- Once it reaches India, the power of attorney must be stamped within three months.
Where to go: Embassy of India, Washington DC, Consulate General of India, New York, Consulate General of India, San Francisco, Consulate General of India, Chicago, Consulate General of India, Houston, Consulate General of India, Atlanta, Consulate General of India, Seattle.
Tax in India and in the USA
- In India, the buyer deducts tax at source under section 393(2) of the Income-tax Act, 2025: for a non-resident individual, 12.5% of a long-term gain (held for more than 24 months) and 30% of a short-term gain, plus surcharge and 4% cess.
- If you owe less, apply before the sale for a lower deduction certificate in Form 128 on the TRACES portal. It needs a PAN.
- In the USA: US citizens and resident aliens are taxed on their worldwide income, so the gain is reported on your US return. Income tax paid in India on the same gain can usually be claimed as a foreign tax credit on Form 1116.
- If your foreign accounts, such as NRO and NRE accounts in India, together exceed USD 10,000 at any time in the calendar year, a US person files an FBAR (FinCEN Form 114) electronically. It is due on 15 April, with an automatic extension to 15 October.
General information, not tax advice. Checked against official sources in October 2026.
Tax and getting the money abroad
- The buyer deducts tax at source (TDS) from the price, at the rate for your capital gain. A chartered accountant can get you a lower deduction certificate before the sale if you owe less.
- The buyer pays into your NRO account. You can send up to USD 1 million a financial year abroad, with Form 145 and Form 146 (which replaced Form 15CA and Form 15CB in April 2026).
- Rural agricultural land is not a capital asset, so selling it carries no capital gains tax.
General information, not tax advice. Read the full guide for NRIs.
Check your land records online

How do I give a power of attorney from the USA to sell property in India?
Sign the power of attorney before a notary in your state, then have it apostilled by the state's competent authority, usually the Secretary of State. How much TDS is deducted when an NRI in the USA sells property in India?
The buyer deducts tax at source under section 393(2) of the Income-tax Act, 2025: for a non-resident individual, 12.5% of a long-term gain (property held for more than 24 months) and 30% of a short-term gain, plus surcharge and 4% cess. If you owe less, apply before the sale for a lower deduction certificate in Form 128 on the TRACES portal.
Do I pay tax in the USA when I sell property in India?
US citizens and resident aliens are taxed on their worldwide income, so the gain is reported on your US return. Income tax paid in India on the same gain can usually be claimed as a foreign tax credit on Form 1116.

Do I need to file an FBAR for my NRO account?
If your foreign accounts, such as NRO and NRE accounts in India, together exceed USD 10,000 at any time in the calendar year, a US person files an FBAR (FinCEN Form 114) electronically. It is due on 15 April, with an automatic extension to 15 October.
